Asset Protection Planning: Fraud, Funding and Future Interests

Description:
Asset Protection Planning: Fraud, Funding and Future Interests discusses two easily overlooked issues that involve asset protection in common estate planning.

First, the course discusses fraudulent transfer traps with common estate planning vehicles, particularly in regard to changes made by the Bankruptcy Abuse Protection and Consumer Protection Act of 2005 (BAPCPA) to the Bankruptcy Code (BC) (11 USC §101 et seq., Bankruptcy Code).

The second discussion deals with asset protection issues surrounding so-called Crummey withdrawal rights. Could the BAPCPA put the common Crummey trust at risk? The course concludes by reviewing the importance of professional trust administration.
